January 24, 2011Seems like the latches themselves might be sticking. (The ones on each side of your tailgate). Try spraying some wd-40 up in there to free them. Hopefully that`s all it is; hope you get it sorted out.

January 24, 2011If WD40 doesnt work just pop off the bezel and look in there, you will be able to see where the rods attach to the handle.
January 24, 2011I recall having this problem fixed on my "03 HD.... the end gate would just drop open from time to time. I brought it in under warranty.
I`d first try the WD40 (I prefer Lithium Grease spray, but your call), than you could try popping the lift handle bezel or rear access panel to see if there is an adjustment that can be made.
January 24, 2011same happened to mine several years back, the latches were rusting and not opening and closing properly. wd40 did the trick.
